These Terms of Use (“Terms”) govern your access to and use of the mindquest mobile application and related services (“Service”) provided by Kazturganov Temirlan (“we”, “us”, “our”). By downloading, accessing, or using mindquest, you agree to these Terms. If you do not agree, do not use the Service.

1. eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use mindquest. If you are under 18, you represent that you have permission from a parent or legal guardian.

Some features require an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access.

We grant you a limited, non-exclusive, non-transferable, revocable license to use mindquest for personal, non-commercial purposes. You agree not to:

mindquest, including its design, questions, graphics, logos, and software, is owned by us or our licensors and protected by intellectual property laws. You may not reproduce or exploit content outside the Service without written consent.

5. virtual currency (coins)

mindquest offers consumable virtual coins that can be used for in-quiz helpers such as extra time and 50/50 hints. Coins have no real-world monetary value, are non-transferable, and may not be exchanged for cash. Unused coins may be forfeited if your account is terminated. All coin purchases are final except where required by applicable law or store policies.

6. subscriptions & purchases

mindquest Premium and coin packs are sold through Apple App Store and/or Google Play. Payment, billing, renewal, cancellation, and refunds are handled by the applicable store and its terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period in your store account settings.

Premium benefits, pricing, and available plans are described in the app. We may change features or pricing with notice where required by law or store rules.

7. leaderboard & user conduct

Leaderboard rankings and achievements reflect in-app performance. We may remove scores, suspend accounts, or reset progress if we detect cheating, abuse, or violations of these Terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, error-free, or secure operation. Quiz content is for entertainment and educational purposes; we do not warrant its completeness or accuracy.

9. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU MADE NO PAYMENTS.

10. termination

You may stop using mindquest at any time and may request account deletion via the app or our account deletion page. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by nature should survive termination will remain in effect.

11. changes to the service & terms

We may update mindquest and these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.

12. governing law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law principles. Disputes shall be subject to the courts of Astana, Kazakhstan, unless mandatory consumer protection laws in your country require otherwise.
